Terms of Use — Desastre

These Terms of Use ("Terms") govern your use of Desastre, a native macOS application (the "Application"), operated by Thais Rodríguez Coso (the "Service Provider").

By downloading, installing, or using the Application, you agree to these Terms. Please read them carefully before using the Application. If you do not agree, do not use the Application.

License to Use the Application

Subject to your compliance with these Terms and, where applicable, the Apple Media Services Terms and Conditions, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on Apple-branded devices that you own or control, for your personal or internal business purposes.

You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application, except as and only to the extent that such activity is expressly permitted by applicable law or by these Terms. You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices in or on the Application.

What the Application Does

Desastre scans your Mac's local filesystem to discover, display, and preview AI tool configuration files (such as those used by Claude Code, Cursor, Copilot, and similar tools). The Application reads these files from your device to present them within the app. The Application does not transmit the contents of your files to the Service Provider or any third party. Your use of the files discovered by the Application, and of the AI tools they belong to, remains subject to the terms of those respective tools.

Privacy and Analytics

The Application collects limited, anonymous usage and diagnostic analytics to help improve the product. It does not collect the contents of your configuration files or other personal documents. Our handling of any data is described in the Privacy Policy, which forms part of these Terms.

Intellectual Property

The Service Provider retains all intellectual property rights in the Application, including its source code, design, trademarks, service marks, trade names, logos, and branding (the "IP"). Nothing in these Terms grants you any license or right to use the Service Provider's trademarks, logos, or branding for any purpose. All such rights remain the property of the Service Provider.

Updates and Availability

The Service Provider may release updates to the Application and may change the operating system requirements needed to run it. To continue using the Application you may need to download and install updates. The Service Provider does not guarantee that it will always update the Application, that it will remain compatible with your operating system version, or that it will continue to be made available. The Service Provider may cease providing the Application or supporting earlier versions at any time.

Disclaimer of Warranties

To the fullest extent permitted by law, the Application is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Service Provider does not warrant that the Application will be uninterrupted, error-free, or that all configuration files on your device will be discovered or displayed accurately.

Nothing in these Terms limits any rights you have under applicable consumer protection laws that cannot be lawfully excluded.

Limitation of Liability

To the fullest extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or business interruption, even if advised of the possibility of such damages.

To the fullest extent permitted by law, the total liability of the Service Provider for any claim shall not exceed the amount you paid for the Application in the 12 months preceding the claim, or the minimum amount that must be paid under applicable law, whichever is greater.

Nothing in these Terms excludes or limits the Service Provider's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

Termination

Your license to use the Application continues until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any of them. Upon termination, you must stop using the Application and delete all copies from your devices. The sections on Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law survive termination.

Governing Law and Jurisdiction

These Terms are governed by the laws of the jurisdiction in which the Service Provider is established, excluding its conflict of law rules, except to the extent that mandatory consumer protection laws of your country of residence provide otherwise. Nothing in this clause limits any rights you may have to bring a claim in a court that is competent under mandatory law.

Apple App Store

If you obtained the Application through the Apple App Store, you acknowledge that these Terms are between you and the Service Provider only, not Apple, and that Apple is not responsible for the Application or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the Application must also comply with the Apple Media Services Terms and Conditions.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Service Provider concerning your use of the Application, superseding any prior agreements or understandings.

Changes to These Terms

The Service Provider may update these Terms from time to time. Updated Terms will be posted on this page, and material changes may be communicated through the Application or the App Store listing. Your continued use of the Application after changes take effect constitutes acceptance of the updated Terms.
